JOGJACAMP - RESELLER




 


ARTICLE 1


OBJECTIVE


This agreement establishes the terms and obligations related to the collaboration as a domain Reseller by CV JOGJACAMP.


 


ARTICLE 2


RIGHTS AND OBLIGATIONS OF JOGJACAMP (REGISTRAR)


2.1 JOGJACAMP (REGISTRAR) provides domain Reseller services.


2.2 JOGJACAMP (REGISTRAR) is obligated to keep confidential all data, documents, records, or information received from RESELLER concerning the implementation of the agreement and shall not disclose it to third parties without obtaining written consent from RESELLER.


2.3 JOGJACAMP (REGISTRAR) provides the application used by RESELLER to manage and place domain orders.


2.4 JOGJACAMP (REGISTRAR) will notify the Reseller via email in case of any new changes to this Agreement.


2.5 JOGJACAMP (REGISTRAR) provides support services for RESELLER.


2.6 JOGJACAMP (REGISTRAR) has the right to establish Policies and Technical Procedures and make changes to the Policies and Technical Procedures following ICANN references.


2.7 JOGJACAMP (REGISTRAR) has no obligation to provide support to the Registrant, as JOGJACAMP (REGISTRAR) is only obliged to communicate with RESELLER.


2.8 If there is communication directly from the Registrant to JOGJACAMP (REGISTRAR), JOGJACAMP (REGISTRAR) will forward that information to RESELLER for follow-up.


2.9 JOGJACAMP (REGISTRAR) has the right to take action for Sub Resellers/Registrants if, within 3 x 24 hours, RESELLER does not respond to emails, calls, and messages from JOGJACAMP (REGISTRAR) regarding Registrants, Sub Resellers, or other important information.


 


ARTICLE 3


RIGHTS AND OBLIGATIONS OF RESELLER


3.1 RESELLER has a website to resell domains to sub-resellers and Registrants.


3.2 RESELLER provides technical services, support, and billing to customers or registrants.


3.3 RESELLER is obligated to establish good communication with Sub Resellers and Registrants.


3.4 RESELLER must pay the domain product prices purchased from JOGJACAMP (REGISTRAR) by deducting the deposit in RESELLER's account.


3.5 RESELLER is required to fill the initial deposit balance of $99 and confirm through live chat, WhatsApp, or phone to Customer Service after transferring the deposit, including providing proof of transfer.


3.6 RESELLER has the right to receive support services related to domain Resellers from JOGJACAMP (REGISTRAR).


 


ARTICLE 4


LIMITATION OF LIABILITY, DISCLAIMERS, AND INDEMNIFICATION


4.1 RESELLER declares and guarantees that, in the implementation of this Agreement, JOGJACAMP (REGISTRAR) will only be responsible for negligence or intentional and proven errors committed by JOGJACAMP (REGISTRAR).


4.2 JOGJACAMP (REGISTRAR) is not responsible for losses related to errors in registration, renewal, and domain transfer approvals by RESELLER or the use of the Domain Name by the Registrant.


4.3 JOGJACAMP (REGISTRAR) is not responsible for losses arising from legal claims due to negligence by RESELLER in carrying out activities as a Reseller, including financial liability arising from such claims.


 


ARTICLE 5


OBLIGATIONS; REPRESENTATIONS AND WARRANTIES


5.1 Fraudulent Transactions. You agree to hold us harmless and to indemnify us in full for and against all liabilities, costs, expenses, damages, and losses (including any direct, indirect, or consequential losses, loss of profit loss of reputation, and all interest, penalties, and legal costs (calculated on a full indemnity basis) and all other professional costs and expenses) suffered or incurred by us arising out of or in connection with any transactions processed by us on your behalf that are fraudulent. These fraudulent transactions could result from, but are not limited to, misrepresentations in the domain name registration or transfer process, or from the use of stolen or misappropriated credit cards.


5.2 Legal Agreements, Policies, and ICANN Requirements. Your Reseller storefront will display a Uniform Term of Service Agreement, Service-level customer agreements, Privacy Policy, ICANN Registrant Rights and Responsibilities, and other legal agreements and policies, some of which your customer will be required to agree to before completing a purchase transaction. 


5.3 Legal Agreements, Policies, and ICANN Requirements. You agree to be bound by our Privacy Policy in your dealings with customers and others and to post a Privacy Policy with similar requirements to ours on your Reseller site home page. You shall also display the ICANN Registrant Rights and Responsibilities, ICANN Registrar Transfer Dispute Resolution Policy, as well as other legal agreements and policies that we may provide from time to time. You also acknowledge and agree that you shall post on your Site and require your customers (at the time of domain name registration) to acknowledge and agree to the Domain Name Registration and Customer Service Agreement that we provide to you. Should you require that your customers accept additional terms and conditions that are not required by ResellerCamp , you agree that such additional terms and conditions shall not conflict with the Domain Name Registration Agreement and the policies and procedures adopted by ICANN.


5.4 The reseller shall comply with any ICANN-adopted Specification or Policy that establishes a program for accreditation of providers of proxy and privacy registration services (a "Proxy Accreditation Program"). Among other features, the Proxy Accreditation Program may require that: (i) proxy and privacy registration services may only be provided by individuals or entities accredited by ICANN according to such Proxy Accreditation Program; and (ii) Registrar prohibit Resellers from knowingly accepting registrations from any provider of proxy and privacy registration services that is not Accredited by ICANN according to the Proxy Accreditation Program. Until the Proxy Accreditation Program is established, Reseller shall comply with the Specification on Privacy and Proxy Registrations.


5.5 ResellerCamp provides privacy protection service upon domain registration at a free cost (no renewal fee). 


5.6 The reseller shall clearly display on any website it operates for domain registration or renewal a link to ICANN's Registrants' Benefits and Responsibilities (currently available at http://www.icann.org/en/resources/registrars/registrant-rights/benefits) and shall not take any action inconsistent with the corresponding provisions of the RAA or applicable law.


5.7 The reseller shall clearly display on any website it operates for domain registration or renewal a link to the appropriate ICANN webpage detailing Registrant Educational Information (currently available at http://www.icann.org/en/resources/registrars/registrant-rights/educational).


5.8 Resellers shall not display the ICANN or ICANN-Accredited Registrar logo, or otherwise represent themselves as accredited by ICANN, unless they have written permission from ICANN to do so.


5.9 If enrolled in the API Resellers Program, Wholesale Program, or WholesalePlus Program, Reseller shall be responsible for providing customer service, billing support, and technical support to Customers unless otherwise provided in the terms on the applicable Reseller Program webpage on the Domain.com website. Registrar shall be responsible for providing customer service, billing support, and technical support to Customers who purchase from Resellers enrolled in the Private Label Program.


 


ARTICLE 6


DURATION


The term of this Agreement is until there is a change in the agreed-upon terms by both parties, a change in services by JOGJACAMP (REGISTRAR), or a mutual request for termination by both parties.


 


ARTICLE 7


FORCE MAJEURE


7.1 Each PARTY is not responsible to the other PARTY in case of delay or non-fulfillment of obligations by each party as specified in the Agreement, as a result of circumstances or events beyond their control (force majeure). Force majeure includes:


7.1.1 Fires, national emergencies, natural disasters, epidemics, or other disasters, riots, unrest, rebellions, states of readiness, wars, sabotage;


7.1.2 Strikes, lockouts, labor issues, work stoppages, embargoes, or other labor-related difficulties;


7.1.3 Any provisions, orders, statements, legal requirements, restrictions, or decisions made by the Government, changes in Legislation, changes in Government policies, Court Decisions, or Determinations/Decisions from authorized authorities that affect the implementation of the Agreement.


In the event of force majeure, the affected PARTY must promptly notify the other party in writing no later than within 7 x 24 (seven times twenty-four) hours from the occurrence of force majeure.


 


ARTICLE 8 


APPLICABLE LAW AND JURISDICTION


This Agreement is subject to and governed by the laws of the Republic of Indonesia.


 


ARTICLE 9


DISPUTE RESOLUTION


9.1 The PARTIES agree that any disputes arising in connection with the implementation of this Agreement will be resolved through mutual consultation.


9.2 If within 14 (fourteen) days from the occurrence of the dispute as referred to in Article 8.1, the PARTIES cannot reach an agreement on the resolution of the dispute, the PARTIES hereby agree to settle it based on the applicable law of Indonesia.


 


ARTICLE 10


AMENDMENT OF THE AGREEMENT


If in the future it is necessary to make changes to this agreement, an addendum to the collaboration agreement will be created, which is an integral part of this agreement.


 


Specific Provisions


Resellers are Prohibited From:



  • Using domains purchased from ResellerCamp for activities contrary to the laws applicable in the territory of the Republic of Indonesia or the laws established in the legal jurisdiction of the Reseller's residence or international law. ResellerCamp is not responsible for the content of Reseller's sites; Resellers are fully responsible for their site content (including usernames and passwords held by the Reseller).

  • Creating content that directly or indirectly contains files such as MP3 files or similar, pirated software, plagiarism of software/websites, hacker and phreaking programs or archives, phishing content, warez sites, internet BOT, BNC, Egg Drop, etc., content violating copyright/patent rights, using ResellerCamp servers for adult/pornographic sites, video/audio streaming, web chat/chat room, web mining cryptocurrency, hosting TOR exit nodes, and related to torrent.

  • Resellers are prohibited from using domains from ResellerCamp for the sale of abortion drugs, the sale of prescription drugs without permission, and any form of sale of illegal or banned drugs.

  • Using ResellerCamp services for selling or buying products, goods, or services that may harm others or for fraudulent purposes with hyip systems, pyramid schemes, money games, chain letters, gambling, and other systems prohibited by the Indonesian Government.

  • Attempting to damage, enter, duplicate, or attempt to change data and systems on ResellerCamp servers that are not the rights of the respective Reseller or engaging in activities that could be categorized as harmful to ResellerCamp's system.

  • Using domain names purchased from ResellerCamp for domain name email purposes and using them to send unsolicited spam emails and mass mail (unsolicited or unwanted product or service offer emails, promotions, affiliate marketing, MLM, or any type of activity that disrupts others or ResellerCamp) is not allowed. Websites deemed to invite spam are also not allowed. If Reseller engages in spamming, the Reseller's account will be immediately blocked without prior notice, and the Reseller must sign a written agreement under seal, accompanied by a copy of the Reseller's ID, and sent by mail to ResellerCamp's address, stating that the Reseller will not repeat the spamming and is willing to be held accountable under the laws of Indonesia. If ResellerCamp's warning is not responded to within 2 weeks, the Reseller's account will be closed.

  • Using domain names purchased to fill content that sells web space, free email forward/POP3/Autoresponder, subdomains, etc., to others without written permission from ResellerCamp.

  • Prohibited from using the content of the ResellerCamp website without the permission of ResellerCamp, including text, images, or other files.

  • Prohibited from using ResellerCamp services for fraudulent purposes. In case of fraud:


    • The third-party as the reporter and Reseller ResellerCamp as the reporter must provide evidence and personal data for verification by ResellerCamp.

    • ResellerCamp conducts verification with the Reseller via email, and it must be responded to within 1 x 24 hours at the latest. If there is no response during this grace period, the domain will be disabled.

    • If the fraud process cannot be resolved amicably, the victim or reporter may use legal processes according to the laws applicable in the territory of the Republic of Indonesia.

    • During the legal process, ResellerCamp will disable the account in question until the issue is resolved.



 


General Provisions:



  • Registries, Registrars, and Resellers may use the Personal Data of Registrants for processing, copying, and modification through the provision of WHOIS services for that data, and may collaborate with third parties to do so, in accordance with and in compliance with data protection and applicable legal regulations.

  • Information on Personal Data of Registrants may be published through the WHOIS service as stipulated in the General Domain Name Policy.

Violations of the Rules & Regulations Above


ResellerCamp May:



  • Issue a strong warning once and impose a fine of up to Rp1,000,000.

  • If two warnings are ignored and violations persist, ResellerCamp will unilaterally terminate services to the Customer without the obligation to refund the remaining deposit.

  • When the Reseller registers on the Resellercamp.id order form and becomes a Reseller from ResellerCamp, all the above rules apply to the Reseller, and the Reseller automatically accepts and agrees to them.
